Heard learned counsel for the petitioner and learned Additional Government Advocate for the State.
The assertion of the petitioner is that he has constructed 300 seated boys hostel of Vikramdev College (Autonomous) pursuant to the agreement in
2016-2017 before the scheduled time. In view of such fact, he is entitled to be granted with incentive as per Para-2.4.1 of the OPWD Code, Vol.1.
In this regard, the Superintending Engineer, Jeypore, (R&B) Circle, Jeypore has recommended the case of the petitioner to the Chief Engineer
(Buildings), Bhubaneswar- Opposite Party No.4, now designated as Engineer in Chief (Buildings).
Regard being had to the facts and submissions and the nature of relief sought for, the writ application is disposed of directing the Engineer in Chief
(Buildings)-Opposite Party No.4 to dispose of the recommendation of the Superintending Engineer, Jeypore, (R&B) Circle, Jeypore, vide Annexure- 4,
within a period of four months from the date of receipt of a certified copy of this Order or true soft copy available in the Orissa High Court’s
website.
The petitioner is directed to supply a copy of the writ application containing all the Annexures to the Opposite Party No.4 for convenience &
reference to Annexure- 4.
The writ application is accordingly disposed of.
As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order
available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide
Court’s Notice No.4587 dated 25th March, 2020 as modified by Court’s Notice No.4798 dated 15th April, 2021.
