Judgment
Ms. Sarvani Desiraju, Ld. Counsel for the OC through VC & Shri Naresh Kumar Sangam, Ld. Counsel for CD in person were present. A Memo signed by the OC dated 01.08.2023 has been filed enclosing the letter of undertaking affidavit by the CD, inter-alia, whereby the CD, undertaken to pay the debt as mentioned in para 6 of the affidavit, to the Operational Creditor The Memo is taken on record.
In the result of this Memo, nothing survives for adjudication, Hence, the Company Petition is disposed of in terms of the Memo and the undertaking affidavit of the CD, with a liberty to revive/reopen this Company Petition, in the event of default, in complying the terms envisaged in the undertaking affidavit, by the Corporate Debtor.
