Judgment
Heard Mr. Mohd. Amair Sohail, learned counsel for the petitioners and Mr. Putta Krishna Reddy, learned standing counsel for respondent Nos.2 and 3.
It is stated that show-cause notice vide Lr.No.MMC/GHAT/310/2026 dated 03.08.2026 was issued to the petitioner calling upon her to submit ownership documents, link documents, permission copy and LRS details, as she was proceeding with construction of room unauthorizedly in Survey Nos.739 to 742 of Korremula Village, Ghatkesar Circle - 06, Uppal Zone, Medchal Malkajgiri Corporation. As petitioner did not respond to the notice dated 03.08.2026, impugned speaking order 07.08.2026 was passed. It is further submitted that petitioner submitted application dated 20.08.2026 under Sections 455-A and 455-AA of the Greater Hyderabad Municipal Corporation Act 1955 (GHMC Act) seeking regularization of unauthorized structures made on the subject property, and prayed for a direction to respondent authorities to consider the said application and protect the interest of the petitioner pending such application.
In view of the above, without entering into the merits of the case, the writ petition is disposed of, directing respondent Nos.2 and 3 to consider the application dated 20.08.2026 of the petitioner submitted under Sections 455-A and 455-AA of the GHMC Act in respect of the room/structure in Plot No.740/A (southern part), Survey No.744, Korremul Village, Ghatkesar Mandal, Medchal Malkajgiri District, and pass orders, in accordance with law, by affording opportunity of personal hearing to the petitioner and all other concerned/interested persons, within a period of four (4) weeks from the date of receipt of a copy of this order. Till such exercise is completed, status quo, obtaining as on today, shall be maintained in respect of the structures standing on the subject property. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
