Judgment
Heard Mr. L. Ram Singh, learned counsel, representing Mr. M. Venkateshwarlu, learned counsel for the petitioner and Mr. Krishna Maragani, learned standing counsel for GHMC, appearing for respondent Nos.2 to 4.
Learned counsel for the petitioner submitted that petitioner has taken permission from the then Almasguda Gram Panchayat vide No.G.P./A/315/2013 dated 28.01.2013 and constructed shed on the subject property. It is not a new construction and repairs have been undertaken recently to the existing shed on the subject property.
Learned standing counsel for GHMC seriously disputed the contention of learned counsel for the petitioner and submitted that site of the petitioner was inspected and it was found that petitioner is making new construction by removing old shed and petitioner neither obtained permission nor applied for regularization under Sections 455-A and 455-AA of the Greater Hyderabad Municipal Corporation Act 1955 (GHMC Act).
Learned counsel for the petitioner submitted that regularization application under Sections 455-A and 455-AA of GHMC Act will be submitted in due course of time.
In view of the above, without going into the merits of the case, the writ petition is disposed of, directing petitioner to submit regularization application under Sections 455-A and 455-AA of the GHMC Act in respect of the subject property i.e., Shed constructed in Survey Nos.237/A/2 and 238/A/3 situated at Almasguda Village, Badangpet Mandal, Ranga Reddy District, within a period of ten (10) days from the date of receipt of a copy of this order.
On receipt of such application, respondent No.2 is directed to consider the same and pass orders in accordance with law, by affording opportunity of hearing to the petitioner and all other concerned/interested persons, within a period of four (4) weeks thereof, subject to the condition of the petitioner depositing costs of Rs.3,00,000/- (Rupees three lakhs only) i.e., (i) Rs.2,00,000/- (Rupees two lakhs only) to the Greater Hyderabad Municipal Corporation, (ii) Rs.1,00,000/- (Rupees one lakh only) to the Telangana High Court Advocates Association (THCAA).
Until such exercise is completed, status quo, obtaining as on today, shall be maintained in respect of the structures standing on the subject property.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
