Judgment
Heard Mr. S. Surender Reddy, learned counsel for the petitioner; and Mr. P. Srinivas Rao, learned Standing Counsel for Malkajgiri Municipal Corporation (MMC) - respondent Nos.2 to 5; and perused the material on record.
Grievance of the petitioner is that respondent No.4 is issuing repeated show cause notices despite the petitioner submitting reply dated 06.05.2026 to the earlier notice dated 04.05.2026 issued under Section 635 of the Greater Hyderabad Municipal Corporation Act 1955 (GHMC Act 1955).
It is submitted that a detailed reply dated 06.05.2026 has been submitted by the petitioner and without considering the same, show-cause notice dated 30.06.2026 has been issued
In the circumstances, the writ petition is disposed of, at the admission stage itself, directing respondent No.4 - the Deputy Commissioner, Circle - 9, Uppal, Malkajgiri Municipal Corporation, to consider the reply dated 06.05.2026 submitted by the petitioner to the show cause notice dated 04.05.2026 and pass orders in accordance with law. Until such exercise is completed, respondent No.4 is directed not to interfere with the possession and enjoyment of the petitioner over the subject property bearing Plot Nos.1215 and 1216, admeasuring 800 square yards, situated at Uppal Bhagayath, HMDA Layout, Uppal, Medchal-Malkajgiri District. No order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
