Judgment
Since the parties and the property involved in these writ petitions is one and the same, with the consent of the counsel on both sides, the writ petitions are disposed of by this common order.
WP.No.20563 of 2026 is filed aggrieved by rejection of the provisional building permission dated 25.05.2026 in respect of property bearing Plot No.75C, Sy.No.65, admeasuring 500 sq. yards, Jubilee Enclave, Madhapur Village and Gram Panchayat, Serilingampally Mandal and Municipality, Ranga Reddy District. WP.No.28192 of 2026 is filed aggrieved by the action of the respondents in sealing the subject property.
Status quo order was granted on 01.07.2026 by this Court in WP.No.20563 of 2026 till the next date of hearing. The petitioner was directed not to raise any further construction or undertake any developmental activity in the subject property.
Learned counsel for the petitioner submitted that notice dated 16.06.2026 was issued under Section 462 of the Greater Hyderabad Municipal Corporation Act, 1955 and thereafter, the subject property was sealed without following due process of law.
Learned counsel for the petitioner further submitted that shortfall letter dated 28.04.2026 was issued after the petitioner obtained building permission under the instant registration/instant approval dated 08.04.2026 under the Build Now Portal. In the shortfall letter, the petitioner was directed to submit LRS proceedings and ULC endorsement copy. Subsequently, rejection of building permission was issued on 25.05.2026 stating that in response to the shortfall letter, the petitioner has not submitted the ULC endorsement copy for construction of ground floor and for residential use in the subject property.
Learned counsel for the petitioner further submitted that by letter dated 22.06.2026, Ex.P9, the ULC Endorsement Copy dated 21.10.2025 and G.O.Ms.No.1280 Revenue (UC.II) Department dated 30.06.2025 were submitted to the respondent No.4. In the said G.O.No.1280, the property of the petitioner is shown at Sl.No.3 (page No.49 of the material paper).
According to the learned counsel for the petitioner, the ULC Endorsement Copy and G.O.Ms.No.1280 were submitted even at the time of submission of building permission. However, the same was not considered. After rejection of building permission order, the ULC endorsement copy was submitted along with representation dated 22.06.2026.
Mr. K. Ravi Mahender, learned standing counsel for Cyberabad Municipal Corporation (CMC), submitted that the provisional building permission of the petitioner was rejected as the petitioner did not disclose the ULC Endorsement (regularization proceedings).
However, as seen from the record, the petitioner's plot was regularized by ULC Endorsement dated 21.10.2005 issued by the ULC Department and G.O.Ms.No.1280 dated 30.06.2005 was issued. Thus, the impugned rejection letter dated 25.05.2026 is set aside.
In the result, the writ petitions are allowed. The respondent No.5 is directed to reconsider the building permission application of the petitioner by taking into account the ULC Endorsement dated 21.10.2005 and G.O.Ms.No.1280 dated 30.06.2005 within a period of twenty one (21) days from the date of receipt of a copy of this order. As it is submitted that property was sealed, the respondent No.5 is directed to unseal the property. However, it is made clear that the petitioner shall not make further construction/improvement over the property until building permission is granted.
The miscellaneous applications, pending if any, shall stand closed. There shall be no order as costs.
