Judgment

Mr. Razat Sudan, learned counsel for the applicant submitted that the applicant is aggrieved of order No. BGSBU/Estab/27/478 dated 07.09.2026, whereby inter alia, the applicant has been transferred and posted at College of Nursing, Kishtwar and order No. BGSBU/CONJ/26/238 dated 07.09.2026, whereby the applicant has been relieved from College of Nursing, Jammu.
As per the learned counsel, the applicant’s children are studying in Jammu and any sudden and forced relocation of the applicant to Kishtwar in the midst of the academic session would seriously and irreparably disrupt and jeopardize the education of her children. It is further submitted by learned counsel that the applicant’s husband works at New Delhi, and the applicant does not have any relative or family member residing at Jammu or Kishtwar, who can take care of her daughters.
Learned counsel for the applicant submitted that the applicant would be satisfied, at this stage, if a direction is issued to the respondents to treat a copy of this O.A. as her representation and decide the same within a time frame and till such time, the applicant may be protected.
Mr. Anuj Dewan Raina, learned counsel appearing on behalf of the respondents, on advance notice, seeks sometime to file reply.
Having heard the learned counsels for the parties, we are of the considered view that no useful purpose would be served in keeping this O.A. pending and same can be disposed of with directions to respondents.
Accordingly, this O.A. is disposed of, at the admission stage itself, without entering into the merits of the case, with a direction to respondents to treat a copy of this O.A. as representation of the applicant and decide the same by passing a reasoned and speaking order, within a period of two week’s from the date of receipt of a certified copy of this order. A copy of the speaking order shall also be communicated to the applicant.
Till then, no coercive action be taken against the applicant to make her join at College of Nursing, Kishtwar.
There shall be no orders so as to costs.
