Judgment
M. A. No. 269 of 2022
This application has been preferred by the original respondent with the following prayer:
"It is therefore prayed by Respondent no. 1 that the application regarding appearance and for filing the 'Response to Petition' and 'Affidavit for Evidence' may be allowed and the same may kindly be ordered."
Having heard the counsel for the applicant (original respondent) and looking to the facts and circumstances of the case, we hereby permit the original respondent to tender his affidavit for evidence so that the original petitioner can Cross-Examine their witness. This permission is granted with a condition of deposition of cost in the sum of Rs. 2500/- payable to TDSAT Employees Welfare Society. The amount will be deposited by way of Demand Draft in favour of TDSAT Employees Welfare Society before the next date of hearing.
Upon deposition of this amount the affidavit for evidence will be taken on record.
M A. No. 269 of 2022 is allowed and disposed of.
B. P. No. 567 of 2017 shall be listed before the Court of Registrar on 23.11.2022 for recording of Cross Examination and completion of pleadings.
