The writ petition has been listed under heading ‘To be Mentioned’ at instance of Court. On earlier occasion, there was submission at the bar that the dispute could be resolved out of Court. As such, our direction to accordingly list.

Mr. Mohanty, learned advocate appears on behalf of petitioner and on 28th August, 2022 had submitted, his client had impugned award dated 15th May, 2018. His client was seeking relief of enhancement of compensation directed. Mr. Ray, learned advocate appears on behalf of the management.

Today Mr. Ray hands up memo dated 22nd February, 2023. Attached thereto is cheque no.000022 dated 13th February, 2023 drawn on Axis Bank Ltd. by his client for Rs.3,25,000/- payable to the workman. The cheque is detached from the memo, copy thereof made and the cheque handed over to Mr. Mohanty, who accepts the same on behalf of his client.

Since it is a cheque, the workman will forthwith present it for payment.

On above record of submissions, the writ petition is disposed of subject to clearance of the cheque. Liberty to mention.
