A.N. Venugopala Gowda, J.—Petitioner was a steward in the Respondent-Hotel. He was issued with a termination letter on 10.12.1987, A dispute was raised challenging the termination by filing claim petition u/s 10-4(A) of the Industrial Disputes; Act, 1947. The Labour Court upheld the order of termination by its order dated 15.12.2006 and as a result rejected the dispute. Feeling aggrieved, the workman approached this Court in W.P. No. 11304/2007, which was allowed in part and the matter was remanded to the Labour Court for fresh disposal. Upon re-consideration, the Labour Court has passed the award dated 19.9.2009 rejecting the claim of the workman.

After hearing the matter for sometime, I found that there are elements of settlement. A suggestion was made to the learned Counsel for the management; that the management may pay compensation of Rs. 30,000/- to the workman and put an end to the matter. In pursuance of the suggestion made, Sri. B.C. Prabhakar, learned Counsel for the Management, today handed over Cheque No. 622354 drawn on Corporation Bank, dated 3.3.2011 for Rs. 20,000/.

Sri. V.S. Naik, learned Counsel for the Petitioner acknowledges receipt of the cheque for Rs. 20,000/-. Sri. B.C. Prabhakar, learned Counsel submits that the balance amount of Rs. 10,000/- would be paid in due course.

The Respondent is directed to pay the balance amount of Rs. 10,000/- within a period of two weeks from today. The cheque for the said amount be delivered to Sri V.S. Naik, learned Counsel for the Petitioner.

In the said view of the matter, the matter having been settled amicably, the writ petition is disposed of.
