Satish Kumar Mittal, J.—The workman has filed the instant Letters Patent Appeal against the order dated 13.9.2010, passed by the learned Single Judge, whereby Civil Writ Petition No. 16305 of 2010 filed by him challenging the award dated 3.2.2010 (Annexure P-3) passed by the Industrial Tribunal-cum-Labour Court, Faridabad, answering the reference against the workman, was dismissed. On August 11, 2011, while issuing notice of motion in this appeal, it was proposed that if the management (respondent No. 2 herein) pays an amount of Rs. one lac to the appellant-workman towards full and final settlement of his claim, this matter will be disposed of as infructuous. At one stage, the respondent-management declined to accept that proposal, but later on, with the intervention of the court, on November 26, 2012, they agreed to accept the said proposal and sought time to pay a sum of Rs. one lac to the appellant-workman.

In view of the aforesaid stand taken by the respondent-management, today an Account Payee Cheque No. 591283 dated December 07, 2012 in favour of the appellant-workman, drawn at Punjab National Bank, Large Corporate Branch, Tolstoy House, New Delhi, has been produced by learned counsel for the respondent-management, which has been accepted by learned counsel for the appellant-workman towards full and final settlement of the appellant-workman. In view of the above, this appeal is dismissed as having become infructuous.
