The matter is taken up for hearing by way of praecipe dated 31. 10.2022 filed by Appellants for seeking urgent relief.
The Appeal is filed impugning the order dated 08.07.2022 of D.R.T.-II, Ahmedabad in Appeal No. 11 of 2018. The Appeal here is filed only on 11.08.2022 with a delay of 3 days. The reason for the delay is explained in the application for condonation of delay and accompanying affidavit.
No reply has been filed but Counsel appearing for the Respondents vehemently opposed the application for delay stating that there is no valid and sufficient cause mentioned in the application.
After considering the entire facts and circumstances of the case, I find that there is only three days delay which has been sufficiently explained and there is no reason to decline to grant the condonation of delay. The application is, therefore, allowed and the delay of 3 days stands condoned.
The Appeal shall be taken on file if there are no other defects to be cured.
The Respondents shall be filed a reply on the main Appeal.
