The Appellants have filed this Appeal challenging the order of the Ld. Presiding Officer, D.R.T.-III, Mumbai dated 02.12.2021. There is a delay of 29 days in filing the Appeal. The reasons for the delay are explained in the application and accompanying affidavit.
The first Respondent Bank has vehemently opposed the application for condonation of delay stating that the Appellant has not approached this Tribunal with a clean hand and therefore, the delay does not deserve to be condoned.
On going through the entire facts and circumstances, in this case, I find that the contentions raised in the Appeal by the Appellants need to be meted out on their merits. Hence, the delay of 29 days in filing the Appeal is condoned.
The Appeal shall be taken on the file, in case there are no other defects to be cured.
The copy of the Appeal Memo shall be handed over to the Ld. Counsel appearing for the Respondent Bank and reply to that shall be filed within four weeks.
Post on 17.10.2022 before Registrar for compliance/reply.
