The matter is taken up for hearing by way of a praecipe filed by the appellants for seeking urgent relief.
The application at Diary No. 2095 of 2024 which is an application for condonation of 9 days delay in filing this appeal. The reasons for the delay are stated in the application.
The Ld. Counsel appearing for the respondent bank has vehemently opposed this application stating that there is no sufficient explanation forthcoming from the side of the appellant to condone the delay.
After hearing both sides, I find that the delay is only 9 days though it is mentioned as 7 days in the application. On perusal of the application, I find that the delay has been properly explained, and therefore, the appellant need not be deprived of their opportunities to contest the matters on merits. Hence, delay stands condoned.
The appeal shall be taken on file in case there are no other defects to be cured.
Heard both sides on I.A. at Diary No. 2096 of 2024 which is an application for a stay.
