This is an application to list the applicants  Misc. Application No.140/2023 for hearing.

Learned counsel for the applicants submits that applicants have filed the aforesaid application before this Tribunal seeking direction to the learned DRT-II, Delhi to hear and decide the applicants S.A.  No.122/2023 and the same has been scheduled for admission hearing on 10.04.2023.  Learned counsel states that there is urgency in the matter as applicants have an apprehension that the Receiver may take possession of the premises in question today itself.

Heard.  Application  allowed  and  the  Misc.  Application  No.140/2023  is taken up for hearing.

This application has been filed by the applicants seeking direction to the learned DRT-II, Delhi to take up the S.A. No.122/2023 titled as 'Sachin Gulati & Ors. vs. UCO Bank & Ors.' at the earliest.

The learned counsel for the applicants states that the applicants have an apprehension that the possession of the property in question will be taken over by the Receiver today.  Learned counsel submits that aggrieved by the actions taken  by  the  respondent   bank  under  the  SARFAESI  Act  in  respect  of  the property question, the applicants have filed S.A No.122/2023, which is pending Heard.  The  learned Presiding  Officer, DRT-III, Delhi,  who  is  holding additional charge of learned DRT-II, Delhi, is requested to take up the applicant's S.A.  No.122/2023 at 2 p.m. today and pass appropriate orders in accordance with law.

With the above direction, the application stands disposed of. File be consigned to record room.

Copy of the order be sent to the learned DRT.
