This application has been filed by the applicants seeking direction to the learned DRT-II, Delhi to take up the applicants' prayer for interim relief(s) in S.A. No.148/2023  titled as  'National Marble  and Sanitary  Store  CD  vs. Punjab National Bank' at the earliest.

The learned counsel for the applicants states that the symbolic possession of the property in question has already been taken by the respondent bank. He states that the bank will also take the physical possession of the property and will sell  the  same  at any time.  Learned  counsel  submits  that  aggrieved  by the actions taken by the respondent bank under the SARFAESI Act, the applicants have filed S.A. (S.A No.148/2023) and sought urgent interim relief(s) in respect of the property question, which is pending  before the learned  DRT-II,  Delhi.   He states that the Fixed Deposit of the applicants lying with the respondent bank is enough to liquidate the all the dues  of the bank,  but the  bank is  proceeding arbitrarily and illegally against the property.  Learned counsel for the applicants further submits that since the  learned  DRT-II,  Delhi  has  no  regular  Presiding Officer and its additional charge has been given to the learned Presiding Officer, DRT-III, Delhi,  his  matter  is  not  being  taken  up.  Learned  counsel  for  the applicants states that the next date fixed in the matter before the learned DRT is 12.05.2023. In these circumstances, the learned counsel states that the learned Presiding  Officer,  DRT-III,  Delhi,  who  is  holding  additional  charge  of  DRT-II, Delhi,  may  be  directed  to  take  up  the  applicants'  prayer for  interim  relief(s) sought in S.A. in question and decide the same at the earliest.

Heard.  The  learned  Presiding  Officer,  DRT-III,  Delhi,  who  is  holding additional charge of learned DRT-11, Delhi, is requested to take up the applicant's prayer  for  interim relief(s)  in  S.A. No.148/2023  at 2 p.m.  today  and  pass appropriate orders in accordance with law.

With the above direction, the application stands disposed of. File be consigned to record room.

Copy of the order be sent to the learned DRT.
