Since the main appeal was dismissed for non-removal of office objections, we are of the opinion that the other side is not required to be heard in the present applications which are filed for restoration of the main appeal as well as condonation of delay caused in preferring restoration application.
Misc. Civil Application No.1 of 2022 is filed for restoration of main appeal which came to be dismissed for non-removal of office objections within the time granted by the coordinate Bench of this Court. Civil Application No.1 of 2023 is filed for condonation of delay of 46 days caused in preferring restoration application.
We have heard learned advocates appearing for the respective parties. We have also gone through the contents of both the applications. We are of the opinion that the present applications require consideration. Hence, both the applications stand allowed. The applicant is directed to remove the office objections on or before 13.4.2023.
