ORDER

This matter is coming up today for reporting compliance of statutory deposit.

This Tribunal, vide its order dated 27.11.2025, directed the petitioner/appellant to deposit 40% of Rs.6,21,17,901/- i.e., Rs.2,48,47,160/- in two equal instalments ( i.e. first instalment on or before 11.12.2025 and the second instalment on or before 26.12.2025) and the said period had expired on 26.12.2026 and that the matter was posted on 26.12.2025 and there was no sitting on that day, the matter was again posted to today for reporting compliance.

When the matter is taken up today, it is reported by the Office as well as by the Ld. Counsel for the parties that pre-deposit, as ordered by this Tribunal on 27.11.2025 is not complied with.

Under the circumstances, this application IA 518/2025 (Waiver) is dismissed for non-compliance of statutory deposit, resulting in rejection of Appeal in AIR (SA) 353/2025 by giving effect to conditional order dated 27.11.2025.
