ORDER
This matter is coming up today for reporting compliance of statutory deposit.
This Tribunal, vide its order dated 05.12.2025, directed the petitioner/appellant to deposit 40% of the amount determined by the Tribunal at Rs.10,87,387.75p. with future interest at 25% p.a. from the date of application (i.e.27.10.2003) till the date of the order in two equal instalments towards pre-deposit and the said period had expired on 09.01.2026 and the matter was posted today for reporting compliance.
When the matter is taken up today, it is reported by the Office as well as by the Ld. Counsel for the parties that pre-deposit, as ordered by this Tribunal on 05.12.2025 is not complied with.
Under the circumstances, this application IA 854//2025 (waiver) is dismissed for non-compliance of statutory deposit, resulting in rejection of Appeal in AIR 788/2025 by giving effect to the conditional order dated 05.12.2025.
