Judgment
Shafat Husain, the applicant was present in person and his advocate was not present in court.
The applicant pleaded that his father was employed with the Delhi Transport Corporation, who unfortunately expired while still in service. The applicant was registered vide registration No. 474 on 20.02.1991 for appointment on compassionate ground. The applicant brings out that along with him some others were also registered for appointment on compassionate grounds. All of them were granted appointment on daily wages, however, the other candidates whose registration number was subsequent to the applicant, have since been regularised whereas he has not been regularised as yet.
The applicant has made first representation on 08.02.1991 which was forwarded by Asstt. Personnel Officer on 20.02.1991 to the HQs with a copy to the applicant. This followed by subsequent many reminders but the respondent has replied on 21.09.2015 only to the representation dated 04.08.2015 whereby he has been informed that his name has already been enrolled at S. No. 474 for Class-IV Cadre for his employment on compassionate grounds and that at present, no vacancy is available in Class -IV Cadre. And accordingly, his request will be considered as per rules alongwith others on merits in due course subject to availability of vacancies in the cadre.
His grievance is that other juniors to the applicant have since been given appointment and they have been regularised, while he is left out. This is the grievance in instant OA.
MA No. 3985/2018 filed by the applicant for condoning the delay in filing the present Original Application, wherein he has pleaded that he was given verbal assurance by the respondents that they are considering his case. The delay in filing the present original application is condoned and the MA stands allowed.
The OA is disposed off at the admission stage itself, without going into merits, with a direction to the respondents to pass a speaking and reasoned order in respect of compassionate appointment to the applicant, keeping in view that if there had been any case where any person registered subsequent to the applicant who has been regularised, the same benefits shall be considered for the applicant also. This entire process will be completed by the respondents within a period of eight weeks and a copy of the speaking order be given to the applicant. No order as to costs.
