The present writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of certiorari for quashing the action of the respondents by which the claim of the petitioner for removal of anomaly in Pay Scale/ACP w.e.f. 04.03.2014 (Annexure P-6) has been declined.
Learned counsel for the petitioner has submitted that respondent No.5 may be deleted from the array of parties.
In view of the statement made by the learned counsel for the petitioner, respondent No.5 is deleted from the array of parties.
The Registry is directed to make necessary correction in the memo of parties.
Learned counsel for the petitioner submitted that the petitioner had served a legal notice dated 27.09.2023 (Annexure P-4) to respondent No.4 but the same has not been considered and decided till date. He further submitted that at this stage, he will be satisfied in case the aforesaid legal notice dated 27.09.2023 (Annexure P-4) is considered and decided by respondent No.4 in accordance with law and in a time bound manner.

On the asking of the Court, Mr. Ashish Yadav, Advocate who is present in the Court and is stated to be on the panel of respondent-Nigam accepts notice on behalf of respondents No.1 to 4. He submitted that in view of the limited prayer made by learned counsel for the petitioner, he has no objection in case time bound direction is issued in this regard.
In view of the aforesaid facts and circumstances, without calling for the reply from the respondents and without expressing anything on the merits of the case, the present writ petition is disposed of with a direction to respondent No.4/Competent Authority to consider and decide the legal notice dated 27.09.2023 (Annexure P-4) strictly in accordance with law and within a period of three months from today.
