The present writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of MANDAMUS directing the respondents to fix the pay of the petitioner for the post of Office Senior Teacher from the date he was appointed in 2001 and direct the respondents to remove the anomaly in pay scale from time to time and allow the LPC after completion of 4 years service as per Rule/Notification and correct the designation as Senior Teacher from the deemed date of appointment dated 02.08.2001 (Annexure P-1) with all consequential benefits alongwith interest at the rate of 18% per annum from the date of approval till the date of realization.

Learned counsel for the petitioner submitted that the petitioner had served a legal notice dated 27.03.2024 (Annexure P-6) to respondent No.1 to 3 but the same has not been considered and decided till date. He further submitted that at this stage, he will be satisfied in case the aforesaid legal notice dated 27.03.2024 (Annexure P-6) is considered and decided by respondent No.1 to 3 in accordance with law and in a time bound manner.

Mr. Rajesh Lamba, learned counsel has appeared on behalf of respondents No.1 to 3 and Mr. Kapil Bansal, learned DAG, Haryana, accepts notice on behalf of respondent No.4. They submitted that in view of the limited prayer made by learned counsel for the petitioner, they have no objection in case time bound direction is issued in this regard.

In view of the aforesaid facts and circumstances, without calling for the reply from the respondents and without expressing anything on the merits of the case, the present writ petition is disposed of with a direction to respondent No.1/competent authority to consider and decide the legal notice dated 27.03.2024 (Annexure P-6) strictly in accordance with law and within a period of three months from today.
