The present Contempt Petition (CP) alleges willful disobedience of the directions of this Tribunal in the captioned OA.
Learned counsel for the respondents places on record compliance affidavit, A copy of the same has been supplied to learned counsel for the petitioner during the course of the day. She states that a detailed speaking order has been passed, the same is reproduced as under:-
“WHEREAS the Hon’ble Central Administrative Tribunal, Principal Bench, New Delhi vide order dated 09.08.2023 in OA 2352/2023 vide Satbir Vs Municipal Corporation of Delhi was pleased to dispose of the said OA with the direction to consider tire pending representation dated 27.09.2021 of Sh. Satbir Singh, ASI(Retd.) within a period of eight weeks without any comment upon the merits of the claim of the applicant and there shall be no order as to costs.
AND WHEREAS record reveals that Sh. Satbir Singh, ASI(Retd.) was re-instated w.e.f. 19.12.2013 by Shahdara South Zone of MCD. Further he had been transferred from DEMS/Shah/South to DEMS/Shah/North on 12.04.2014.
Accordingly, SALARY BILL for period 20.12.2013 to 27.09.2018 has been prepared and forwarded to Accounts Department for approval based on voucher verification and duty period.
This order is issued with the approval of Competent authority.”
Drawing attention to the aforesaid order, learned counsel for the petitioner submits that the speaking order has been passed in favour of the petitioner; however no time limit has been stipulated in the aforesaid speaking order.
Learned counsel for the respondents contends that the directions passed in the captioned OA are complied with in letter and spirit by the respondents. . There is no willful disobedience on the part of the respondents.
We have gone through the contents of the affidavits filed by the respondents. We observe that the speaking order has been passed in favour of the petitioner without assigning any specified time limit.
Accordingly, we close the present Contempt Petition, with an expectation that salary shall be released to the petitioner within a period of two months from today. Notices stand discharged.
No order as to costs.
