An Anticipatory Bail Application (No.338 of 2024) was filed by the present applicant for grant of Anticipatory Bail under Section 7A of the Prevention of Corruption Act, 1988 in connection with the First Information Report No.25 of 2020, registered at police station Jaspur, District Udham Singh Nagar.
The said Anticipatory Bail Application was allowed on 16.04.2024.
Heard Mr. Sanjay Kumar, learned counsel for applicant and Mr. Rakesh Negi, learned Brief Holder for State.
Mr. Sanjay Kumar, Advocate, contended that a supplementary charge-sheet was filed by the Investigating Officer under Sections 409, 420, 466, 467, 468, 471 and Section 120B of the Indian Penal Code, 1860 in connection with the same First Information Report No.25 of 2020, registered at police station Jaspur, District Udham Singh Nagar. Learned concerned Magistrate has taken cognizance under the said offences i.e. Sections 409, 420, 466, 467, 468, 471 and Section 120B of the Indian Penal Code, 1860 against the present applicant.
Mr. Rakesh Negi, learned Brief Holder, submitted that the applicant was granted anticipatory bail on 16.04.2024 and the Investigating Officer does not want to interrogate the applicant.
The present Anticipatory Bail Application (No.397 of 2024) is allowed. Applicant-Sanu Gazi alias Mohammad Amzad Gazi is directed to be released on anticipatory bail, in the event of his arrest, on the same terms and conditions as imposed by this Court on 16.04.2024 in Anticipatory Bail Application No.338 of 2024.
