This Application has been filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of Anticipatory Bail under Sections 120B, 409, 420, 467, 468 and Section 471 of the Indian Penal Code, 1860 in connection with the First Information Report No.256 of 2020 (Special Sessions Trial No.28 of 2023), registered at police station Jaspur, District Udham Singh Nagar.
Heard Mr. Ankush Kumar Tyagi, learned counsel for applicant and Mr. Rakesh Negi, learned Brief Holder for State.
Mr. Ankush Kumar Tyagi, Advocate, contended that a supplementary charge-sheet was filed against the present applicant in the said First Information Report No.256 of 2020, registered at police station Jaspur, District Udham Singh Nagar under Section 7 and Section 8 of the Prevention of Corruption Act, 1988. An Anticipatory Bail Application (No.135 of 2024) was filed by the applicant. An Anticipatory Bail was granted to the applicant on 16.02.2024. Now, the applicant is seeking anticipatory bail under Sections 120B, 409, 420, 467, 468 and Section 471 of the Indian Penal Code, 1860 in the said First Information Report No.256 of 2020.
Mr. Rakesh Negi, learned Brief Holder, conceded that the applicant has already been granted anticipatory bail under Section 7 and Section 8 of the Prevention of Corruption Act, 1988.
In the said circumstances, applicant- Satyendra Kumar alias Satendra is directed to be released on anticipatory bail, in the event of his arrest, on the same terms and conditions as imposed on 16.02.2024.
Anticipatory Bail Application (No.353 of 2024) stands disposed of accordingly.
