This is the Second Anticipatory Bail Application.
On 15.01.2024, applicant – Bhukan Singh was granted Anticipatory Bail under Section 7(a) and Section 8 of the Prevention of Corruption Act, 1988 in connection with the Case Crime No.40 of 2020, registered at police station I.T.I., District Udham Singh Nagar.
Ms. Sarita Bisht, Advocate, contended that the Investigating Officer has filed an additional charge-sheet in the same case crime number i.e. Case Crime No.40 of 2020, registered at police station I.T.I., District Udham Singh Nagar. The concerned Court has taken cognizance for the offence under Sections 409, 420, 466, 467, 468, 471 and Section 120B of the Indian Penal Code, 1860.
Heard Ms. Sarita Bisht, learned counsel and Mr. Piyush Sammal, learned counsel for the applicant and Mr. Rakesh Negi, learned Brief Holder for the State.
The applicant is seeking anticipatory bail under Sections 420, 409, 466, 467, 468, 471 and Section 120B of the Indian Penal Code, 1860.
Learned counsel appearing for the State submitted that the Investigating Officer does not want to interrogate the applicant.
The applicant – Bhukan Singh is directed to be released on Anticipatory Bail, in the event of his arrest in the offence under Sections 409, 420, 466, 467, 468, 471 and Section 120B of the Indian Penal Code, 1860, on the same terms and conditions as imposed on 15.01.2024 in the Anticipatory Bail Application No.59 of 2024 and on the same set of sureties which he has already furnished before the concerned Court in Anticipatory Bail Application No.59 of 2024.
The Second Anticipatory Bail Application (SABA No.16 of 2024) is disposed of accordingly.
