By way of the present OA, the applicants have sought pay parity with regular employees working on similar post and discharging similar duties and the benefits of Order/Judgment dated 12.8.2014 passed by this Tribunal in OA 2947/2003, titled Sindhu & others vs. Govt. of NCT of Delhi and others, which is stated to have been upheld by the Hon'ble Delhi High Court vide Order/Judgment dated 28.3.2017 in Writ Petition (Civil) No.717/2015 titled Govt. of NCT of Delhi and others Kamal Kant Sharma and others.
Learned counsel for the applicants argues that keeping in view the Order dated 24.11.2020 of this Tribunal in OA 1881/2020 (Annexure A/12), the present OA may also be disposed of with liberty to the applicants to make individual comprehensive representations for redressal of their grievances and with direction to the respondents to consider such representations of the applicants in a time bound manner.
In view of the aforesaid, we are of the considered view that if such a request of learned counsel for the applicants is accepted, no prejudice is likely to be caused to the respondents.
In view of the aforesaid, without going into the merit of the claim of the applicants, the present OA is disposed of with liberty to the applicants to make individual comprehensive representations for redressal of their grievances within two weeks and if such representations are received within two weeks, the respondents are directed to consider the same and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within 10 weeks thereafter.
The OA is disposed of in the aforesaid terms. No costs. Pending MA also stands disposed of accordingly.
