HON’BLE SHRI R.N. SINGH, MEMBER (J):

The present application has been filed seeking the following reliefs:-

“(A)

Direct the Respondents to grant parity of scales to the Beldars of the Irrigation and Flood Control Department of the GNCTD with that of the Beldars employed with the Central Works Public Department alongwith all consequential benefits including but not limited to ACP, MACP and Pensionary benefits w.e.f. the date of their respective appointment and grant them arrears as granted to Applicants in O.A. No.154/2001 vide order dated 10.08.2001; or

(B)

In the alternative direct the Respondents to grant parity of scales to the Beldars of the Irrigation and Flood Control Department of the GNCT with that of the Beldars employed with the Central Works Public Department alongwith all consequential benefits including but not limited to ACP, MACP and Pensionary benefits w.e.f. the respective dates of grant of 1st ACP benefit and grant them arrears as granted to Applicants in O.A. No.154/2001 vide order dated 10.08.2001; and

(C)

Pass any other appropriate order or relief which this Hon’ble Tribunal deems fit and proper.”

Learned counsel for the applicants argues that the applicants have preferred various representations, i.e (Annexure A8 collectively) and the same are still lying pending consideration of the respondents in spite of lapse of more than a year.

Issue notice. Shri Amit Yadav, proxy counsel appearing for Ms Esha Mazumdar, learned counsel for respondents, appears on advance service, accepts notice.

At this stage, learned counsel for the applicants submits that the applicants shall be satisfied if the present OA is disposed of with direction to the respondents to consider the applicants’ pending representations (Annexure A8 Collectively) and to dispose of the same by passing a reasoned and speaking order in a time bound manner.

We are of the considered view that if such request of the learned counsel for applicants is accepted, no prejudice is likely to be caused to the respondents.

In view of the aforesaid, without going into the merits of the claim of the applicants, the present OA is disposed of with direction to the respondents to consider the applicants’ aforesaid representations (A8 Collectively) and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within 12 weeks of receipt of copy of this Order.

The present OA is disposed of in above terms.

Pending MA also stands disposed of accordingly. No order as to costs.
