Per: Mr. Kumar Rajesh Chandra, Member (A):

1.

None appeared for the applicant. Heard ld. counsel for the respondents.

2.

Looking at the record, I find that on the previous date, the counsel for applicant Mr. Jayant Kumar Karn had submitted that he is not in touch with the applicant for the last few years and he has no instruction. He had himself requested to issue notice to the applicant regarding the present case.

3.

Accordingly, notice was issued to the applicant to appear either in person or through effective legal representative on the next date of hearing if she wants to pursue the matter.

4.

Today, despite issuance of this notice, neither the applicant nor any legal representative on her behalf has appeared. Accordingly, this Tribunal is constrained to believe that the applicant is not interested in pursuing this case any further that relates to compassionate appointment where the employee had died on 13.07.2001 while Bench working against the post of Gate-keeper under Senior Section Engineer (P.Way-I), Jamalpur, as recorded in paragraph no. 4.1 of the OA.

5.

Hence, this OA is dismissed for want of prosecution.

6. No order as to costs.
