COMMON ORDER: (As per Hon'ble Sri Justice P. Sam Koshy)

Heard Mr. Alluri Divakar Reddy, learned counsel for the petitioner and Mr. T. Sharath, learned Government Pleader for Medical Health appearing for the respondents. Perused the record.

Since the issue raised in the instant Writ Petitions is one and the same, they are heard together and are decided by this Common Order.

The present two writ petitions have been filed to declare the action on the part of the respondents in putting up the names of the two petitioners in the list of ineligible candidates which was released recently. The petitioners have been put in the list of ineligible candidates on the ground that the petitioners having not studied within the territory of the State of Telangana since Class 6th onwards.

The case of the petitioners is that after pursuing their studies up to Class 5th within the territory of the State of Telangana, they had cleared the examination for being admitted in the Sainik School in the unified State of Andhra Pradesh, there was only one Sainik School in the entire combined State of Telangana and Andhra Pradesh which is located at Vizianagaram, now in Andhra Pradesh State. The two petitioners herein got admission and had done the studies from the said School at Vizianagaram, Andhra Pradesh.

The contention of the writ petitioner in WP No.28387 of 2026 that he is a native of Narayanpet District, Telangana State and was born on 13.10.2007 at Narayanpet, Telangana State. The petitioner did his schooling from Class I to V from Noble High School, Marikal (V&M), Narayanpet District, Telangana. Subsequently, the petitioner has got selected for admission to Sainik School Korukonda, Andhra Pradesh under Telangana State Quota and Joined the said School on 04.03.2018 for studying his class VI to XII.

The petitioner in WP No.28407 of 2026 contends that he is a native of Ranga Reddy District, Telangana State and was born on 19.08.2007 at Ranga Reddy District, Telangana State. The petitioner has did his schooling from Class I to II from Kranthi Model School, Madhuban Colony, Kattedan, Ranga Reddy District, Telangana and his Class III from Shree Swaminarayan Gurukul International School, Moinabad, Ranga Reddy District, Telangana and his Class IV from Janapriya High School, Attapur, Hyderabad, Telangana and his Class V from Korukonda Vidya Nikethan, Mayuri Nagar, HUDA Colony, Miyapur, Hyderabad, Telangana. Subsequently, the petitioner has got selected for admission to Sainik School Korukonda, Andhra Pradesh under Telangana State Quota and Joined the said School on 04.02.2018 completed his class VI to XII.

It is pertinent to mention at this juncture that the two candidates got themselves admitted and they have participated in NEET admission process, declaring themselves to be under the State of Telangana Quota and after completion of the studies, they have now participated in NEET (UG) 2026-27 Exam. But, they have not been included in the eligible candidates list on account of their having not studied in the State of Telangana for the last 5 years.

The identical matters before the co-ordinated Bench of this High Court i.e., in W.P.No.19659 of 2025 and W.P.No.27933 of 2025, were allowed on 17.09.2025 and 24.07.2025 respectively. The relevant portion in the W.P.No.27933 of 2025 is extracted hereunder:

"4.

This matter was adjourned yesterday to enable the learned counsel for the State to seek instructions. Today, when the matter has been taken up, learned Advocate General submits that the petitioner, who has studied in Sainik School in the State of Andhra Pradesh under the Home State category, can be treated as local candidate. The petitioner would be permitted to exercise his web option and will also be called for counselling. It is submitted that since there was one Sainik School where the students of both the States have undertaken their studies, in view of arrangement made under Section 95 of the Andhra Pradesh Reorganization Act, 2014, the Department has decided to grant relaxation to the students of Telangana State who have studied in Sainik School in the State of Andhra Pradesh, till 2024 i.e., in the last ten (10) years."

Learned counsel for the petitioner therefore, submits that the matter may be disposed of so that the petitioner can approach the respondent University for consideration of his case as a local candidate for admission into MBBS & BDS Courses for the academic year 2025-26.

In view of the submission of the learned Advocate General that the petitioner has been permitted to exercise his web option and will be called for counselling treating him as a local candidate, the grievance of the petitioner has been redressed.

Learned counsel for the petitioner submits that the petitioner in the aforesaid writ petition is the batch-mate of the two petitioners herein.

Learned counsel appearing for the State and also the learned standing counsel appearing for the University does not dispute the fact that the issue involved in the present case is fairly covered by the aforesaid judgment, and where the Government has itself conceded after granting relaxation to such students.

In view of the same, we have no hesitation in allowing the writ petition holding that the inclusion of the petitioners in the list of ineligible candidates is improper and illegal and the same deserved to be and accordingly set aside.

The petitioners are directed to approach the respondent/University with a request for consideration of their case as local candidate for the admission into the MBBS and BDS course for the academic session 2026- 2027. Thereafter, let the respondents take appropriate steps in including the name of the two petitioners herein in the eligible local candidates list as a local candidate.

Accordingly, the present Writ Petition stand allowed. There shall be no order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
