Judgment
ORDER:
With the consent of the parties, the writ petition is heard finally.
This writ petition is filed for the following relief:
“a)declaring the proviso to Rule 3(a)(iii) of the Telangana Medical and Dental Colleges Admission (Admission into MBBS & BDS Courses) Rules, 2017, as amended by G.O.Ms.No.150, Health, Medical & Family Welfare (C1) Department, dated 08.09.2025, insofar as it excludes children of employees of the erstwhile common State Public Sector Undertakings/Power Utilities whose service outside Telangana continued as a consequence of State bifurcation, as illegal, arbitrary, discriminatory and violative of Articles 14 and 21 of the Constitution of India;
b)to read the said proviso so as to include such candidates whose parent’s service outside Telangana arose from the bifurcation of the erstwhile State and not from voluntary migration or fresh employment outside Telangana;
c)further declare the action of the 2 respondent-Kaloji Narayana Rao University of Health Sciences in treating the petitioner as “NL Non-Local” in the Final Merit List dated 09.09.2026 for MBBS/BDS Admissions under Management Quota for the Academic Year 2026-27 as illegal and arbitrary;
d)consequently direct the 2 respondent to treat the petitioner as a Local Candidate for admission into MBBS/BDS Courses pursuant to NEET (UG)-2026, under the local component of Management Quota Category-B seats, in terms of G.O.Ms.No.130 dated 27.09.2022 read with G.O.Ms.No.150 dated 08.09.2025, permit her to participate in the ongoing and further counselling, and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”
Learned counsel for the petitioner submits that the petitioner belongs to Scheduled Tribe-Lambadi Community. Petitioner’s parents were compelled to continue their employment in two different successor States i.e., father of the petitioner in TSGENCO in Telangana and mother of the petitioner at Dr.NTTPS under APGENCO in the State of Andhra Pradesh, pursuant to which petitioner studied Classes VII to X in the State of Telangana and Intermediate in the State of Andhra Pradesh. Petitioner had appeared for NEET UG-2026 examination and secured 303 marks out of 720 and All India Rank of 584254 and ST Category Rank of 26106. The name of the petitioner appears in the Final Merit List at S.No.4717, but against the Column relating to local status, she has been classified as “NL – Non-Local”. Learned counsel for the petitioner, however, after some arguments submits that the petitioner would file a representation and the University be directed to decide the same in a time bound manner.
Learned Standing Counsel for the University submits that in case the petitioner submits a representation, the same shall be dealt with by the University in accordance with law.
In view of the aforesaid submissions, the Writ Petition is disposed of with liberty to the petitioner to submit a representation to the University with regard to her grievance. In case, such a representation is made, the University shall decide the same, in accordance with law, and pass a reasoned order before the next counselling. It is made clear that this Court has not expressed any opinion on the merits of the case. There shall be no order as to costs.
Miscellaneous applications pending, if any, shall stand closed.
