Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.

These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Kabisuryanagar PS Case No.232 of 2026 corresponding to GR Case No.228 of 2026 pending in the file of learned JMFC, Kabisuryanagar for commission of offences punishable U/Ss. 109(1)/l15(2)/118(1)/190/ 333 of BNS, on the main allegation of committing rioting, along with other accused persons being armed with deadly weapons and attempting to the life of injured Akhaya Kumar Patra, Ajaya Kumar Patra and Tukula Patra by assaulting them with such lethal weapons.

Heard, Mr. Rajendra Narayan Rout, learned counsel for the petitioners; Mr.Bikash Karna, learned counsel for the informant and Mr. R.B.Mishra, learned Additional Public Prosecutor in these matters and perused the record.

At the outset, Mr.Rajendra Narayan Rout, learned counsel for the petitioners brings it to the notice of the Court that co-accused Shantilata Behera & others standing on similar footing have already been granted bail by a Co-ordinate Bench of this Court in ABLAPL No. 5095 of 2026. Mr. Rout by highlighting the above, accordingly, prays to grant bail to the petitioners on the same stipulation as imposed by the Co-ordinate Bench in ABLAPL No. 5095 of 2026. Perused the said order passed by the Co-ordinate Bench in ABLAPL No. 5095 of 2026, wherein the release of co-accused persons who appears to be standing on similar footing is further stipulated by not to extend the benefit of the said order to the accused persons therein, if they are having antecedents or anyone from the side of the informant receiving grievous injury during the alleged incident and the order shall still be acted upon if the petitioners in ABLAPL No. 5095 of 2026 or anyone from their side equally receiving grievous injury, but the said order has not been challenged by the informant/State in any forum as admitted by Mr.Bikash Karna, learned counsel for the informant or by the State counsel. The present petitioners are in custody since 22.04.2026 and in the meantime, charge sheet has already been submitted. Besides, the allegation appearing in the FIR discloses that the petitioners and 18 others have attacked the injured persons.

In the aforesaid premises and on consideration of materials placed on record together with grant of bail to co-accused Shantilata Behera & others in ABLAPL No. 5095 of 2026, this Court without expressing any view on merit admits each of the petitioners to bail on the same terms and conditions as imposed on the co-accused in ABLAPL No. 5095 of 2026.

Hence, these two bail applications of the petitioners namely Sahil Raulo @ Sahil Raula @ Gunjan (In BLAPL No.5649 of 2026) and Santunu Sethy @ Santunu Sethi (In BLAPL No.5654 of 2026) are allowed and each of the petitioners is allowed to go on bail on same bail amount on such terms and conditions as deem fit and proper by the Court in seisin over the matter.

In view of the specific submission as advanced for the petitioners, the benefit of this order shall not be extended to the petitioners, if the concerned petitioner(s) is/are having criminal antecedent and anyone from the side of the informant has received grievous injury/injuries during the alleged incident, provided further the petitioners shall still be released on bail, if the petitioners or anyone from their side has equally received grievous injury/injuries.

Accordingly, both the BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
