Since these three bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Tiring PS Case No.31 of 2026 corresponding to CT Case No.293 of 2026 pending in the file of learned SDJM, Rairangpur, for commission of offences punishable U/Ss.191(2)/191(3)/126(2)/115(2)/109 (1)/326(f)/303(2)/190/105 of BNS, on the main allegation of committing culpable homicide not amounting to murder of the deceased Sandip Bindhani and attempting to the life of the injured Rakesh Mohanta by assaulting them with lathis, along with co-accused persons in prosecution of their common object.
Heard, Mr. Alok Kumar Panda, learned counsel for the petitioner in BLAPL No.6100 of 2026; Mr. Tara Prasad Mohapatra, learned counsel for the petitioner in BLAPL No.7108 of 2026; Ms. Bini Mishra, learned counsel for the petitioner in BLAPL No.7420 of 2026 and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record.
After having considered the rival submissions upon perusal of record, there appears allegation against some of the petitioners and 20 to 25 other persons for assaulting the deceased and the injured as the deceased and the injured were allegedly found in stealing goat. Further, no criminal antecedent has been reported against any of the petitioners. Besides, the petitioners are in custody since 03.03.2026 and, in the meantime, charge-sheet has already been submitted. In the aforesaid facts and circumstances and taking into account the materials so placed on record keeping in view the other circumstances on record in entirety including the inherent right of the accused-petitioners to be presumed innocent until proven guilty at the trial and there being no material to suggest that the petitioners would abscond or pose threat to the witnesses in the event of their enlargement on bail, this Court without expressing any view on merit, admits each of the petitioners to bail.
Hence, these three bail applications of the petitioners namely Tunu Mundari, Chandra Mundari and Bhagirathi Mundari (In BLAPL No.6100 of 2026); Ashok Kumar Mohanta (In BLAPL No.7108 of 2026) and Budhan Majhi (In BLAPL No.7420 of 2026) are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two solvent sureties for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
