Judgment
Hon’ble Mr. R.N. Singh, Member (J) : In the present OA, the applicant is aggrieved of inaction at the end of the respondents in considering his request letter dated 02.11.2020, wherein the applicant has prayed for not taking any action pursuant to the charge memo dated 19.08.2019.
Heard learned counsels for both the parties.
Shri Ajesh Luthra, learned counsel who appears for respondents on advance service, submits that the Disciplinary Authority is the Regional Manager whereas the applicant has made the representation to the Depot Manager.
In the facts and circumstances, Shri S.N. Sharma, learned counsel for the applicant submits that the present OA may be disposed of with liberty to the applicant to make an appropriate representation before the competent Disciplinary Authority and the Disciplinary Authority may be directed to consider such representation of the applicant in a time bound manner. To such request of the learned counsel for the applicant, there is no objection from the learned counsel for the respondents.
In the facts and circumstances, without going into the merits of the case, the present OA is disposed of with liberty to the applicant to make an appropriate representation before the competent Disciplinary Authority within five days from today and if such representation is received by the Disciplinary Authority within the stipulated time, it shall consider the same and dispose it of by passing an appropriate speaking order as expeditiously as possible and in any case, within four weeks from the date of its receipt.
OA stands disposed of in the aforesaid terms. No costs.
