Heard.
Quashing of charge-sheet under section 498-A and 323/34 RPC filed by the police in FIR No. 54/2009 of Police Station, Bahu Fort is sought by the
petitioners (accused) on the ground that petitioner No. 1 and respondent No. 2 have now arrived at a compromise and on the basis whereof their
marriage has been dissolved by a decree of divorce dated 07.06.2017 by the court of learned Additional District Judge (Matrimonial cases), Jammu.
FIR (Supra) was registered on the basis of a report lodged by respondent No. 2. Respondent No. 2 is present in the Court.Â
Learned counsel for respondent No. 2 states that she and the petitioners have entered into a compromise and she is now no more interested in
prosecution of the petitioners. Statement of the learned counsel is taken on record. Respondent No. 2 also admits the same. Admittedly, the
matrimonial discard between petitioner No. 1 and respondent No. 2 was the basis of multiple litigation between the parties and the FIR (Supra) was
lodged during those days. Now that the parties have arrived at a compromise, it would be in the fitness of things and interest of justice that
proceedings in the charge-sheet are closed, which otherwise may turn up a futile exercise.Â
Viewed thus, this petition is allowed and charge-sheet arising in FIR(Supra) pending in the Court of learned Chief Judicial Magistrate, Jammu is
quashed.
Disposed of.
