Judgment
Heard.
Inherent jurisdiction of this Court under section 561-A Cr.P.C. is invoked to seek quashing of charge sheet under section 498-A/109 RPC filed against
the petitioners, arising in FIR No. 03/2014 of Police Station, Women Cell, Jammu, which was registered on the basis of a report lodged by herein
respondent No.3.Quashing is sought on the basis of compromise arrived at between the parties after filing of the charge sheet.
Learned counsel for the petitioners, Mr. Basit Manzoor Keng, Advocate, states that parties have arrived at a compromise, which has been reduced
into writing in Compromise Deed dated 21.04.2018 (enclosed as Annexure B). Learned counsel states further that after the compromise, petitioner
No.1 and respondent No.3 are living together peacefully in the matrimonial house since 2016 so the charge sheet, which involves the commission of
non-compoundable offences, may be quashed.Â
Learned counsel appearing on behalf of respondent No.3, Mr. Faheem Ahmad Mir, Advocate admits the factum of compromise arrived at between
the
parties and states that respondent No.3 is no more interested in prosecution of the petitioners. Statements of the learned counsel on each side are
taken on record.
In view of the compromise arrived at between the parties and having regard to the nature of accusation and the relation between the parties, it would
be in the fitness of things that criminal litigation between the parties now is closed.
Viewed thus, this petition is allowed and charge sheet (supra) is quashed.
