Judgment
This is an application filed in terms of Section 22(3)(b) of the IBC, 2016 for appointment of the Resolution Professional along with the written consent from the proposed Resolution Professional.
Heard the Ld. Counsel on behalf of the Applicant. This Adjudicating Authority vide order dated 12.09.2024, has initiated CIRP and has appointed Mr. Rakesh Kumar as the IRP. Thereafter, the CoC in its meeting held on 07.12.2024, with 66.57% voting has resolved to replace the said IRP with Mr. Rabindra Kumar Mintri registration no. IBBI/IPA-001/IP-P00707/2017- 2018/11194. The written consent of the said Resolution Professional is also placed on record. Therefore, in terms of Section 22(3)(b) of the IBC, 2016, we hereby appoint Mr. Rabindra Kumar Mintri (details of which are given above) as the Resolution Professional. The newly appointed Resolution Professional shall exercise his functions and duties, in accordance with the provisions contained in the IBC and the Regulations made thereunder. The existing IRP is relieved from his duty and directed to hand over all the papers and documents available with him, to the newly appointed Resolution Professional. The CoC is also directed to pay the remaining amount of fees and expenses, if any to the earlier IRP. Copy of this order be communicated to the newly appointed Resolution Professional and IBBI for information. With these observations, the present IA is disposed of.
