ORDER
IA 65/2025 (NEW IA) in C.P. (IB)/244(MB)2023
Ld. Counsel, Krishnan Iyer a/w Rahul Pillai appeared for the Applicant.
This Application has been filed by the Applicant u/s 22(3)(b) of Insolvency and Bankruptcy Code, 2016 seeking replacement of Respondent/IRP in place of Ms. Vaishali Arun Patrikar having Registration no. IBBI/IPA-002/IP-N00812/2019-2020/12566 to carry out the CIRP of the Corporate Debtor as Resolution Professional.
Ld. Counsel appearing for the Applicant informs that the resolution to appoint the proposed RP was approved with 100% voting by the CoC of the Corporate Debtor in compliance with the provision of section 22(3)(b) of the Code, 2016.
Ld. Counsel for the Applicant further submitted that the proposed RP has provided her consent to act as Resolution Professional in Form B dated 11.11.2024.
Having considered the submissions made by the Applicant and having gone through the record this bench appoints Ms. Vaishali Arun Patrikar having Registration no. IBBI/IPA-002/IP-N00812/2019-2020/12566 as Resolution Professional of the Corporate Debtor in place of the IRP/Respondent. IRP/Respondent shall stand discharged after handing over all records of CIRP of the Corporate Debtor to the newly appointed RP. Further, the RP shall ensure that the dues of IRP/Respondent are duly taken note of and settled expeditiously in accordance with provisions of the Code.
Accordingly, IA 65/2025 is allowed and disposed of.
