Judgment
Mr. Nausher Kohli, Ld. Counsel for the Applicant present. Mr. Pournima Jayant Tungatkar, IRP present in person.
IA-5331(MB)2023: This is an application filed u/s 22 of the Code by the Committee of Creditors seeking replacement of IRP.
Ld. Counsel for the applicant submits that the IRP pursuant to publication has received claims of Operational Creditor consequent to the which the CoC was constituted with Operational Creditors.
The first CoC meeting was held on 31.10.2023 and resolved by 99.96% to replace Ms. Pournima Jayant Tungatkar, with Mr. Jayesh Natvarlal Sanghrajka, having Registration No. IBBI/IPA-001/IP-P00216/2017-2018/10416 as the Resolution Professional.
Counsel for the Applicant further submits that Mr. Jayesh Natvarlal Sanghrajka has provided his written consent dated 31.10.2023 in the prescribed form i.e. Form AA, to act as the Resolution professional of the Corporate Debtor.
This bench Ms. Pournima Jayant Tungatkar having registration No. IBBI/IPA-002/IP-N01188/2021-2022/13989 to discharge his duties as Resolution Professional in terms of section 22 of the Code.
The bench has considered the submissions made by the applicant, and hereby confirm the appointment of Mr. Jayesh Natvarlal Sanghrajka, having registration No. IBBI/IPA-001/IP-P00216/2017-2018/10416 to act as Resolution Professional of the Corporate Debtor.
The RP is directed to submit the progress report as per the provisions of the Code.
In view of the above, IA-5331(MB)2023 is allowed and disposed of accordingly.
