Judgment
This is an application filed on behalf of the CoC to replace the IRP in terms of Section 22(2) of the IBC. Heard Ld. Counsel for the Applicant. It is submitted that this Adjudicating Authority vide order dated 10.09.2024, had appointed Ms. Dikshita Sharma as IRP of the Corporate Debtor. The CoC in its 2nd meeting held on 11.11.2024 with 100% voting has resolved to replace the said IRP with Mr. Mukesh Kumar Jain having Registration No IBBI/IPA-001/IP-P01960/2020-2021/13089 in terms of Section 22(2) of the IBC and the present application has been filed in terms of Section 22(3)(b) of the IBC. The written consent and the valid AFA of the proposed new RP has also been filed. In view of the provisions contained in Section 22(2)(3) and in view of the resolution passed by CoC with 100% voting, we hereby appoint Mr. Mukesh Kumar Jain whose details are given above as RP. The newly appointed RP has to act in terms of the provisions contained in the code and the Regulation made therein. The existing IRP is relieved from her duty and is directed to hand over all the documents and material available with her to the newly appointed RP. The CoC is also directed to pay the remaining fees of the existing IRP. The copy of this order be communicated to the newly appointed IRP and to the IBBI for information.
