Judgment
The Officers of the Rajasthan State Pollution Control Board (RSPCB) inspected the site of Nagar Palika Bari, District Dholpur and found that the unit has failed to ensure compliances of the provisions of the Solid Waste Management Rules, 2016 and calculated the environmental compensation according to the parameter laid down by the Central Pollution Control Board (CPCB) and the order of the Hon’ble Supreme Court of India passed in Writ Petition Civil No. 375/2012, Paryavaran Suraksha Samiti vs. Union of India & Ors. in light of the order passed by this Tribunal in OA No. 606/2018 and issues notice calculating the environmental compensation to deposit it within a time limit.
Aggrieved by the order, the applicant has filed this Miscellaneous Application to waive the penalty/environmental compensation imposed by the RSPCB.
The order passed by the State PCB is appealable order and the applicant has an alternate remedy to file an appeal/revision before the appropriate forum according to the rules.
This MA is not maintainable for challenging the order impugned and thus not maintainable.
This application stands disposed of accordingly.
