Hon’ble Mr. Mohd. Jamshed, Member (A)

The husband of the applicant joined the Military Engineering Services (MES) in the year 1992. He died while in service on 04.05.2021. By filing this OA, the applicant is seeking a direction to the respondents to grant all the retiral dues including family pension, leave encashment etc. in her favour.

2.

Learned counsel for the applicant submits that in this behalf the applicant has made various representations to the respondents and the same are still pending.

3.

Heard Mr. Sushant Sagar, learned counsel for the applicant and Mr. Sanjeev Yadav, learned counsel for the respondents, at the stage of admission, through video conferencing.

4.

At the outset, Mr. Sushant Sagar, learned counsel for the applicant submits that the applicant will be satisfied, if her latest representation dated 24.12.2020 to the respondents, is considered and decided by the respondents in a time bound manner. To such request of learned counsel for the applicant, there is no objection from Mr. Sanjeev Yadav, learned counsel for the respondents.

5.

Accordingly, without going into the merits of the case, the present OA is disposed of, at the admission stage itself, with a direction to the respondents to decide the latest representation of the applicant dated 24.12.2020 by passing a reasoned and speaking order, as early as possible, and in any case not later than two months from the date of receipt of a copy of this order. This shall be done without any prejudice to the rights of the respondents. There shall be no order as to costs.
