Deliverd by Hon'ble Mrs. Justice Vijay Lakshmi, Member-J :

We have joined this Division Bench online through video conferencing.

2.

Heard Shri U.P.Srivastava, learned counsel for the applicant, who is present in Court and Shri G.K. Tripathi, learned counsel for the respondents, who is present online.

3.

At the very outset, learned counsel for the applicant submitted that the applicant is a poor illiterate widow, whose husband died on 31.01.2017. However, no retiral dues or family pension has been paid to the applicant. In this regard, she had filed a representation dated 05.10.2020 before respondent no. 2/D.R.M., Northern Railway, Moradabad. However, no order has been passed on her representation till today.

4.

Learned counsel for the applicant submits that the applicant will be satisfied at this stage if, the respondent concerned/competent authority amongst the respondents, is directed to decide her pending representation dated 05.10.2020, by passing a reasoned and speaking order in a time bound manner.

5.

Learned counsel for the respondents has no objection to such innocuous prayer.

6.

In view of the limited prayer made by learned counsel for the applicant and considering the fact that a representation dated 05.10.2020 is already pending for consideration before the respondents, this Tribunal is of the view that no useful purpose will be served in keeping this matter pending.

7.

Accordingly, the OA is disposed of finally at admission stage with direction to the respondent No. 2/competent authority amongst the respondents, to decide the representation dated 05.10.2020, by passing a reasoned and speaking order within a period of three months from the date of receipt of certified copy of this order.

8.

The order so passed, shall be communicated to the applicant without any delay.

9.

It is made clear that we have not expressed any opinion on the merits of the case.

10.

No order as to costs.

11.

Hon'ble Shri Devendra Chaudhry, Member (Administrative) has consented to this order during video conferencing.
