Judgment
Heard Mr. Rudresh Deshpande, learned counsel for the petitioner, Mr. Putta Krishna Reddy, learned standing counsel for the respondent No.2 and Mr. M. Sahas Reddy, learned Assistant Government Pleader for Revenue, for respondent No.3.
Learned Assistant Government Pleader for Revenue furnished written instructions and submitted that as per Bhubharathi record of Kannala shivaru, Bellampally Mandal, the land in Sy.No.98/1 to an extent of Ac.4.00 guntas is recorded as Government/Sarkari land and is included in the prohibited properties list under Section 22-A(1)(b) of the Registration Act, 1908. The petitioner has not been recorded as a pattadar or owner of the subject land in the revenue record. The land claimed by the petitioner is situated in Sy.No.98/1 whereas Ward No.16 where the petitioner was sanctioned Indiramma House is located at a considerable distance from Sy.No.98/1. The officials of the Revenue Department never visited Ward No.16 for demolition activity and they have been only conducting regular inspections of Government land in Sy.No.98/1 with a view to prevent illegal encroachments and safeguarding Government property.
Recording the aforesaid submissions, the writ petition is disposed of. However, the respondents No.2 and 3 are directed to follow due process of law if any action is initiated against the petitioner.
The miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
