Hon’ble Shri B. Anand, Member (A)

M.A. No. 4395/2026

1.

The present M.A. has been filed seeking permission of the Tribunal to file the accompanying O.A. jointly.

2.

For the reasons explained therein and keeping in view no objection from the learned counsels for the respondents, the M.A. is allowed.

O.A. No. 3440/2026

1.

By way of the present O.A., the applicants have prayed for the following relief(s):-

“I. Direct the Respondent to calculate and release the entire arrears of salary and other consequential monetary benefits payable to the Applicants pursuant to their respective regularisation, pay fixation and consequential service orders, from the respective dates from which such benefits became due;

II. Direct the Respondent to release all consequential benefits, including pay fixation arrears, 7th CPC difference, bonus, MACP benefits and other admissible dues, individually payable to each Applicant;

III. Direct the Respondent to pay interest on the delayed payment of arrears and other lawful dues from the respective dates on which the amounts became due till the date of actual payment;

IV. Direct the Respondent to consider and decide the representations submitted by the Applicants and thereafter release the admissible amount within a time-bound period as may be fixed by this Hon’ble Tribunal;

V. Pass any other or further order(s) as this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the present case.”

2.

Learned counsel for the applicants submits that the applicant have given various representations (Annexure A3 colly) airing their grievances including the latest one dated 05.08.2026. He submits that the applicants would be satisfied if a direction were to be given to the respondents to decide their pending representations including the latest one dated 05.08.2026 by way of a reasoned and speaking order.

3.

Issue notice to the respondents. Mr. Aman Oberoi, learned counsel, who appears on advance service, accepts notice. He seeks a reasonable period of time to file reply.

4.

However, keeping in view the limited prayer made by the learned counsel for the applicants, the O.A. is disposed of at the admission stage itself with a direction to the respondents to consider and decide the pending representations, annexed as Annexure A3 Colly, of the applicants including the latest one dated 05.08.2026 by way of a reasoned and speaking order as expeditiously as possible and preferably within six weeks from the date of receipt of a certified copy of this order. However, the respondents are directed to release the arrears to the applicants if they are otherwise eligible.

5.

It is made clear that I have neither gone into the merits of the case nor commented upon the claim of the applicants.

6.

The O.A. stands disposed of in the aforesaid terms. There shall be no order as to costs.
