This Original Application is registered on the basis of the letter petition dated 31.08.2023 received from one Rampal and other villagers of village Jharera, Delhi Cantt. The grievance in the OA is that there is a person by the name of Suraj in the locality who is running a dairy from his residential house by keeping 25-30 cows. It is the allegation that the connecting lane is very narrow and it is always filled with cow dung which blocks the sewer also and results into foul smell and threat of dengue, malaria etc. Further plea of the applicant is that as per the orders of the court dairies cannot be operated in the residential area but in his locality that order is being violated.

The  OA  raises  substantial  issue  relating  to  compliance  of  the environmental norms.

Hence, we disposed of the OA directing the Member Secretary, Delhi Pollution Control Committee (DPCC) to get the spot inspection done, ascertain the correct factual position and take appropriate remedial action in accordance with law by duly following the principles of natural justice and submit an action taken report before the Registrar General of the Tribunal by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF and if found necessary the matter will be listed before the Bench for consideration.

OA is accordingly disposed of.

A copy of this order, along with a copy of the petition, be forwarded to the Member Secretary, DPCC by e-mail for necessary action.
