Judgment
The grievances in this letter Petition sent by Mr. Ram Niwas Parasher resident of House No. 224, Bhagat Colony, 25 Foota Road, Opp: Pinki Appartment, West Sant Nagar, A-2 Block, Burari, Delhi, which has been treated and registered as original application, are that garbage is being stored in area adjoining his residence. Cows come to the garbage site for eating the garbage. The garbage is also emitting foul smell and small school going children using the road have to cover their faces to avoid bad smell. The applicant sent emails to the concerned authorities detailing the gravity of the problem of garbage dumping in the neighbor-hood but no action has been taken despite various orders passed by this Tribunal regarding garbage disposal and waste management.
In view of the averments made in the letter petition, we are of the view that the factual position needs to be verified and remedial action is required to be taken on the basis thereof by the concerned Statutory Authorities. We accordingly constitute Joint Committee of DPCC and Commissioner, Municipal Corporation, Delhi and District Magistrate (North) Delhi and direct the same to verify the factual position, look into the grievances of the applicant and take remedial action in accordance with law by following due process within one month from the date of receipt of a copy of this order. The DPCC will be the Nodal agency for coordination and compliance.
Factual and action taken report may be furnished within two months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF, before the Ld. Registrar General, National Green Tribunal, Principal Bench, New Delhi who may, if necessary, put up the matter before the Bench for further directions.
The application is disposed of accordingly.
A copy of this order along with a copy of the application be forwarded to the DPCC and Commissioner, Municipal Corporation, Delhi and District Magistrate (North), Delhi bye-mail for compliance.
