Judgment

The petitioner by way of present petition seeks the following directions:-
(i) The Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the respondents No.2 & 3 to decide the application filed by the
petitioner for grant of regular Stage Carriage Permit accordance with the provisions of Section 80 of the Motor Vehicle Act and may also directed to
grant the permit to the petitioner, as applied by him.
(ii) Any other relief which this Hon'ble Court may deem fit in the circumstances of the case, may also be granted to the petitioner, together with the
cost of this petition.
Having regard to the relief sought, the provisions contained under Section 80 of the Act of 1988 and the law laid down by the Apex Court in the case
of Mithilesh Garg v. Union of India and others: AIR 1992 SC 443 , and without expressing any opinion on the merits of the case, the petition is
disposed of with a direction to the respondent No.2 to decide the application, if any, preferred by the petitioner, as contained in Annexure P-2 within a
period of 30 days from the date of communication of this order.
