This is yet another case which reflects a very poor state of affair, as the writ petition has been filed under Article 226 of the Constitution of India for a direction to the Deputy Commissioner, Seraikella-Kharsawan to forward the lower court record (LCR) of Miscellaneous Case No. 04/2020-21 which was disposed of by the Deputy Commissioner, Seraikella-Kharsawan vide order dated 03.11.2021 arising out of Settlement Case No. 60/1999-2000.
It is submitted by the learned counsel on behalf of the petitioner that against the order passed by the Deputy Commissioner on 03.11.2021, Miscellaneous Appeal No. 08/2022-2023 has been preferred before the Commissioner, Kolhan at Chaibasa, but the matter is still pending as the LCR has not been sent to the Appellate Court.
Under the circumstance, the Deputy Commissioner, Seraikella-Kharsawan is directed to forward the lower Court record (LCR) to the Commissioner, Kolhan at Chaibasa for reference in Miscellaneous Appeal No. 08/2022-2023 within four weeks from the date of receipt/production of a copy of this order.
This writ petition stands disposed of.
