In the present O.A., filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has sought the following relief(s):-

“ 8.1 That this Hon’ble Tribunal may be graciously pleased to allow this application and quash the Impugned order No. 230/Electric/PRE/Rail Accom/Gzb/2018, dt: 8-1-2018 passed by Sr Chief Crew Controller, Northern Railway, Ghaziabad (Annexure A-I) in terms of which the applicant has been directed to vacate Quarter No. L-5, Arya Nagar, Ghaziabad within two months.

8.2

That the Hon’ble Tribunal may also be pleased to direct the respondents to consider filing of a review/appeal against the aforesaid judgment which had been obtained by suppressing material facts and the earlier judgment.

Pass any other or further order which this Hon’ble Tribunal may deem fit and proper in the circumstances of the case.

That the cost of the proceedings may kindly be granted in favour of the applicant and against the Respondents.”

At the outset, learned counsel for the respondents submits that railway quarter No. L-5, Arya Nagar, Ghaziabad, which was the subject matter of the present O.A., has been vacated by the applicant on attaining the age of superannuation. Therefore, the O.A. has become infructuous.

Learned counsel for the applicant submits that despite her best efforts she is unable to contact the applicant and seek necessary instructions.

In view of the submissions made by the learned counsel for the parties, the O.A. is dismissed as having become infructuous.

Pending M.A., is any, shall also stand disposed of accordingly. There shall be no order as to costs.
